These terms are an agreement between you and Fogbreak Studio ([Fogbreak Studio legal entity name], "we", "us") about Fogbreak — the game, this website and our related services. Please read them together with the Privacy Policy, the Refund Policy and the Drop Rates page.
1. Who can play
- Fogbreak is free to play. You may use it if you can agree to these terms under the law of your country, or with the permission of a parent or guardian who agrees to them for you.
- We ask for a month and year of birth once to set your account up. Accounts of younger players automatically get protections: for example, no real-money purchases, no ads and no optional analytics for children, and a monthly spending cap for teens.
- Parents and guardians: if you believe your child made a purchase without permission, contact us through the support form.
2. Your account
- You can play as a guest. A guest account lives in your browser and can be lost if you clear your browser data. Adding an email and password keeps it safe and lets you play on other devices.
- Keep your password private. You are responsible for activity on your account unless it was used without your permission and you tell us promptly.
- One person per account. Accounts cannot be sold, traded or shared.
3. Your licence to play
We give you a personal, non-exclusive, non-transferable, revocable licence to play Fogbreak for non-commercial purposes. The game, its code, art, story and characters belong to us or our licensors.
4. Gems and other virtual items
- Gems are the only premium currency in Fogbreak. Gems and other virtual items give you a limited licence to use them in the game. They have no cash value, cannot be exchanged for money and cannot be transferred to other players or sold outside the game.
- Purchased gems do not expire while your account exists.
- We do not sell randomized items. Every purchase shows exactly what it contains before you pay. See Drop Rates.
- We may rebalance the game. We will not reduce the stated contents of an item you already bought.
5. Purchases
- Prices are shown in real money before you pay, including taxes where the law requires. One item has the same price for everyone in the same country and currency.
- Payments are processed by our payment partner [name of the payment provider / merchant of record]. We never see or store your card details.
- Items are delivered after the payment partner confirms your payment, usually within seconds. Some purchases are checked by a person before delivery, usually within 24 hours.
- You can set daily and monthly spending limits and pause purchases in your account. Purchases need an account with a verified email address.
- Right of withdrawal (EU/UK): gems and items are digital content supplied immediately. Before checkout you are asked to agree to immediate delivery and to acknowledge that you then lose your 14-day right of withdrawal. Our Refund Policy still applies, and so do your statutory rights if the content is faulty.
- If a payment is reversed (refund or chargeback), the items from that purchase are removed. If they were already spent, your gem balance can become negative and purchases and gem spending are paused until it is settled. Your account stays playable.
6. Fair play
Do not cheat, use bots or modified clients, exploit bugs, manipulate leaderboards, attack our services, harass other players or impersonate others. Runs are checked on our servers; results that cannot be verified earn no rewards. We may remove rewards gained unfairly and suspend or close accounts that break these rules. We tell you why and you can contact support to appeal.
7. Changes to the game and to these terms
- Fogbreak is a live game and changes over time. If we ever shut it down, we will announce it at least [60] days in advance and stop selling gems at that time.
- We may update these terms. For material changes we will tell you in the game or on this site before they take effect. If you do not agree, you can stop playing and delete your account.
8. Ending the agreement
You can delete your account at any time in your account (with a 14-day grace period). We may suspend or end your access if you seriously or repeatedly break these terms, or where the law requires it.
9. Liability
Nothing in these terms limits rights you have as a consumer under mandatory law, or liability that cannot be limited by law (for example for death or personal injury caused by negligence, or for fraud). [Limitation of liability clause to be drafted by counsel for EU, UK and US consumers.]
10. Governing law and disputes
[Governing law and venue to be set once the legal entity is chosen.] If you live in the EU or the UK, you keep the protection of the mandatory consumer laws of your country and may bring claims in its courts. Please contact support first — most problems are solved quickly.
